Custory & Visitation

When a couple gets divorced, in cases where the custody and the visitation of children is involved, the court has to formulate a parenting plan, that must provide for the time-sharing of the children, with specific schedules, and resolve issues of the children's education, health and other rights. The whole idea of time-sharing is to make children realize that they have two parents and that both parents, despite their personal differences, are entitled have both of them in their lives, to love and to be loved in return.

In addition, time-sharing maintains the bond between the non-residential parent and the children even though the matrimonial bond has been broken by the divorce. In considering issues between parents and their children, the best interest of the child is the primary consideration by the courts. Therefore, parental responsibility for a minor child will be shared by both parents so that each retains full parental rights and responsibilities with respect to their children, unless the court determines that shared parental responsibility would be detrimental to the child (which is not common).
